These Terms of Service govern your use of usmodelshop.com and purchases made from US Model Shop.

By accessing the website, placing an order, or otherwise using our services, you agree to these Terms of Service and to the policies referenced below. Please review them carefully before using the website or completing a purchase.

These Terms should be read together with our:

If a product-specific term conflicts with a general provision in these Terms, the product-specific term will apply to that product.

Eligibility and Appropriate Use

You must be legally capable of entering into a binding agreement to place an order.

Our collectible models are intended primarily for adult collectors and hobbyists. Products identified as appropriate only for adults are not toys and should not be purchased for unsupervised use by children.

You may use this website only for lawful purposes. You may not use the website:

• To commit or facilitate fraud
• To submit false, misleading, or inaccurate information
• To interfere with the website’s operation or security
• To introduce malware, automated attacks, or harmful code
• To scrape, copy, reproduce, or commercially exploit website content without authorization
• To impersonate another person or use payment information without authorization
• To place orders that you do not intend to pay for or accept

We may restrict or terminate access to the website when we reasonably believe these Terms have been violated.

Website Content and Intellectual Property

The website and its original content, including product descriptions, classification systems, measurement information, graphics, logos, photographs, layout, and written materials, are owned by or licensed to US Model Shop and are protected by applicable intellectual-property laws.

You may view and use the website for personal shopping and informational purposes.

You may not reproduce, republish, distribute, modify, scrape, sell, license, or use our content, product descriptions, original photographs, or data for commercial purposes without prior written permission.

Manufacturer names, product names, logos, trademarks, and manufacturer-provided images remain the property of their respective owners.

Product Information

We make reasonable efforts to provide accurate product titles, descriptions, classifications, photographs, dimensions, availability information, and specifications.

Because many collectible models are hand assembled, hand painted, weathered, or produced in batches, individual examples may contain minor variations in paint application, markings, finish, weathering, or component positioning.

Colors may also appear somewhat different because of photography, lighting, display settings, or monitor calibration.

Product images may include multiple views, enlarged details, manufacturer images, or representative production examples. Accessories, scenery, figures, vehicles, packaging, or display materials shown in an image are not included unless the product description states otherwise.

Scale and Dimensions

Customers are responsible for reviewing the stated scale and available product dimensions before ordering.

Model photographs are often enlarged to display detail and should not be used by themselves to estimate physical size.

Measurements are provided in good faith and may be approximate because of the shape of the model, protruding components, production variation, or measurement method.

A customer’s misunderstanding of the product scale or expected physical size is not considered a defect and is handled under our Return & Refund Policy as a change-of-mind return.

Availability

All products are subject to availability.

Placing an item in a shopping cart does not reserve it. Inventory may change before checkout is completed.

Although we work to maintain accurate inventory information, an item may occasionally become unavailable because of simultaneous purchases, inventory discrepancies, damage discovered before shipment, supplier information, or technical error.

If we cannot fulfill an order or part of an order, we will notify you and refund the amount paid for the unavailable item.

Pricing

All prices are displayed in U.S. dollars unless otherwise stated.

Prices, promotions, availability, and product information may change without notice before an order is accepted.

We may correct typographical, pricing, promotional, inventory, or product-information errors.

If an obvious pricing or listing error affects an order, we may cancel the affected item or order and issue a refund to the original payment method. We may also contact you and offer the opportunity to purchase the item at the corrected price.

Taxes

Applicable sales tax will be calculated and collected when required.

Customers are responsible for any use tax or similar obligation not collected during checkout, as required by applicable law.

Order Submission and Acceptance

Submitting an order is an offer to purchase the products in that order.

An automated order-confirmation email acknowledges that we received the order but does not necessarily mean that the order has been accepted.

We may review an order before accepting it, including reviewing:

• Billing and shipping information
• Address validity
• Order quantity
• Suspected fraud or unauthorized activity

An order is generally accepted when we send a shipping confirmation or otherwise expressly confirm acceptance.

• Inventory or pricing errors
• Unusual quantities

• Delivery restrictions
• Previous unresolved payment disputes or abusive conduct

If we cancel a paid order, we will refund the canceled amount to the original payment method.

Payment

You represent that you are authorized to use the payment method provided and that the billing information submitted is accurate.

Your payment method may be authorized when the order is submitted and charged in accordance with the checkout process.

We may request additional information when reasonably needed to verify an order. Failure to provide sufficient verification may result in delay or cancellation.

Shipping and Delivery

Orders are shipped according to our Shipping Policy and the shipping information displayed during checkout.

Estimated processing, shipping, and delivery times are estimates rather than guarantees unless we expressly state otherwise.

Customers are responsible for providing a complete and accurate delivery address.

We are not responsible for delays or delivery problems caused by an incorrect or incomplete address provided by the customer. Additional shipping costs resulting from an address error may be the customer’s responsibility.

If we become unable to ship within the stated or legally applicable time, we will provide any notice, delay option, cancellation option, or refund required by applicable law.

Carrier Tracking and Delivery Records

Carrier tracking information is part of the order record.

A carrier’s delivery scan, delivery photograph, signature, geographic scan information, package weight, or other delivery documentation may be considered when reviewing a delivery claim.

Customers should promptly check the delivery location, household members, property staff, neighbors, and any location identified in the carrier’s delivery information before reporting a package missing.

Nothing in this section prevents a customer from submitting a legitimate claim or exercising rights available under applicable law.

Returns, Refunds, and Order Problems

Returns, refunds, damaged-item claims, incorrect-item claims, incomplete orders, and change-of-mind returns are governed by our Return & Refund Policy.

Customers must contact us before returning an item.

Sending an item back without authorization does not guarantee that the return will be accepted or refunded.

Chargebacks and Payment Disputes

Please contact us first if you believe there is a problem with your order. We want an opportunity to investigate and resolve legitimate concerns.

Submitting false information in connection with a chargeback, payment dispute, delivery claim, damage claim, or return may violate these Terms.

We may provide payment processors, financial institutions, carriers, insurers, law-enforcement authorities, or dispute-resolution services with relevant order records, tracking information, correspondence, photographs, package information, and transaction documentation when reasonably necessary to respond to a dispute or investigate suspected fraud.

Product Safety

Collectible models may contain small, delicate, pointed, sharp, removable, or breakable components.

Unless a product page expressly states otherwise, our detailed collectible models are not intended as toys and are not suitable for young children.

Customers are responsible for:

• Reviewing all product warnings and age recommendations
• Safely storing and displaying collectible models
• Keeping small or sharp components away from children and pets
• Handling delicate components carefully
• Following manufacturer instructions and safety information
• Using appropriate ventilation and protective equipment when working with hobby paints, adhesives, tools, or chemicals

Some products, accessories, or hobby materials may require assembly or may involve tools, adhesives, paints, or other materials. Customers must follow the applicable manufacturer instructions and warnings.

We are not responsible for injury or property damage caused by misuse, unauthorized modification, negligent handling, failure to follow warnings, or use of a product for a purpose for which it was not intended, to the extent permitted by law.

Customer Damage and Modification

US Model Shop is not responsible for damage occurring after delivery because of mishandling, dropping, forced removal of components, disassembly, modification, repainting, repair attempts, improper storage, improper display, or failure to follow handling instructions.

Modifying, repainting, repairing, disassembling, or otherwise altering a product may affect return eligibility as described in our Return & Refund Policy.

Third-Party Services

The website may rely on or link to services provided by third parties, including Shopify, payment processors, shipping carriers, social-media platforms, mapping services, or external websites.

Those services may be governed by separate terms and privacy policies.

We do not control and are not responsible for the independent content, availability, security, or practices of third-party websites and services.

Website Availability

We do not guarantee that the website will always operate without interruption, delay, error, or security incident.

We may update, suspend, restrict, or discontinue part of the website when reasonably necessary for maintenance, security, legal compliance, or business operations.

Disclaimer of Website Warranties

To the extent permitted by applicable law, the website and its informational content are provided on an “as available” basis.

We do not guarantee that the website will be uninterrupted, error-free, or free from harmful components.

This website disclaimer does not eliminate any product warranty, consumer right, or remedy that cannot legally be excluded.

Limitation of Liability

To the maximum extent permitted by applicable law, US Model Shop will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from use of the website or products.

To the maximum extent permitted by applicable law, our total liability arising from a particular product, order, or transaction will not exceed the amount paid to US Model Shop for the product or transaction giving rise to the claim.

These limitations do not apply where liability cannot legally be excluded or limited, including any rights or remedies provided by applicable consumer-protection law.

Indemnification

To the extent permitted by law, you agree to be responsible for losses, claims, or expenses resulting from your unlawful use of the website, fraudulent conduct, violation of these Terms, or infringement of another party’s rights.

This provision does not require a consumer to indemnify US Model Shop for US Model Shop’s own unlawful conduct, negligence, or breach of these Terms.

Information collected through the website is handled according to our Privacy Policy.

By submitting information through checkout, a contact form, or another website feature, you represent that the information is accurate and that you are authorized to provide it.

Nothing in these Terms limits a consumer’s right to bring a claim in a forum or under a law that cannot legally be excluded.

Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions will remain in effect to the extent permitted by law.

No Waiver

Failure to enforce a provision of these Terms does not waive our right to enforce that provision later.

Entire Agreement

These Terms, together with the policies and product-specific terms referenced in them, form the agreement between you and US Model Shop concerning your use of the website and purchases from the store.

Changes to These Terms

We may update these Terms periodically.

The revised version will display a new “Last updated” date and will apply to website use and orders occurring after the revised Terms become effective.

Changes will not retroactively alter the material terms applicable to a completed purchase unless required by law or agreed to by the customer.
